Federal Minister of the Environment and Climate Change Jonathan Wilkinson yesterday informed the Government of Ontario of his intent to take the measures necessary for Ontario to transition from the federal Output-Based Pricing System (OBPS) to the Ontario Emissions Performance Standards (EPS) on January 1, 2022 (read our bulletin on the EPS here). Additional information on the steps required to complete the transition process will be communicated in the coming months.

 

Yesterday’s announcement follows Minister Wilkinson’s September 20, 2020 determination that Ontario’s carbon pricing system for industrial facilities met the federal government’s minimum stringency benchmark requirements, as well as the December 23, 2020 Notice of Intent to make regulations in response to the stated intention to stand down the OBPS in Ontario.

 

The Ontario Ministry of the Environment, Conservation and Parks consulted on regulatory amendments to transition Ontario industrial facilities from the federal OBPS to Ontario’s EPS earlier this year.
